(PRNewsChannel) / Bolingbrook, Ill. - When Illinois State Police urged local prosecutors to charge Drew Peterson with a weapons violation they probably never figured on a sensational photo surfacing that shows Peterson on-duty holding the AR-15 speaking with a well-known actor.
The photograph released today by Peterson not only has him carrying the weapon, but receiving an autograph from John Travolta.
This, Peterson's criminal defense attorney says, proves that his client, a former sergeant on the Bolingbrook, Ill. police department did, in fact, use the assault weapon while on duty, despite what state police want the public and the court to believe.
"This photo should convince the state police that they've made a mistake with these charges," says Joel A. Brodsky, Peterson's criminal defense attorney. "If not we might need to subpoena Mr. Travolta when this case goes to court," Brodsky says jokingly.
The photo of Peterson and Travolta was taken in Bolingbrook when Sgt. Peterson was assigned to offer police protection to Mr. Travolta when he was in town on a book signing tour promoting the movie Battlefield Earth.
State police pursued a class three felony charge against Peterson because they claim the barrel on the weapon is too short and violates state law.
But Peterson claims that the Illinois law that governs barrel size restrictions only applies to civilians, not on duty police officers.
Brodsky says the charge is nothing more than an attempt to rattle his client.
Despite the charge, a judge last week ordered the state police to return eight of 11 weapons they seized when they began to investigate the disappearance of Peterson's fourth wife, Stacy. Authorities have labeled Peterson a prime suspect.
If convicted of unlawful use of a weapon, Peterson faces up to five years in prison.
A court date is scheduled for May 30.
