Los Angeles police arrested Sutherland on suspicion of drink-driving in Los Angeles early this morning.

Sutherland is best known as the terrorist-fighting special agent Jack Bauer on the FOX TV show "24."

Officers stopped Sutherland in West Hollywood at around 1am.  He was booked for misdemeanor driving under the influence after testing over the legal limit.

Is it legal to refuse the test?  What are Sutherland’s legal options?  Is this a slam dunk case for prosecutors or will this be a case of celebrity justice?

The arrest is the second time Sutherland has been stopped for drink-driving in five years, according to celebrity Web site TMZ.com.

Under California law if Sutherland is convicted he must serve a minimum of five days in jail.
